Messenger X Terms of Services

Messenger X (TrandX, We, Our or Us) provides instant messaging and audio and video calls, media messages and other types of services around the world. By accessing our website (trandx.com or http://trandx.com or www.trandx.com or in any other format) or using our App (Messenger X available on the AppStore), features, services, software or downloading or installing our app (together “Services”), we consider that you Read, Understand and accept our Terms of Use (“Terms”), Privacy Policy and Cookie Policy.

This document is sometimes updated, and its your responsibility to check it for updates. We will try to notify you with 30 days before any change but we can’t guarantee you will get this notifications. Any update of this Terms is considerate as an accept from you if you continue to use our Services.

About our Services

     Access

To have access to our services you need an X Account that can be created for free using our in app registration form. To create the X Account you have to provide some informations, like a valid email address, you Full Name, You current location and a profile photo. You will assume that all info provided are accurate.

     Age

You must be at least 13 years old  (or parental approval) to use our Services or such greater age required in your country to can assume our Terms of Services. Using our services under this age or without the parental approval is considerate as violation of our Terms and your account can be terminated.

     Taxes and Fees

At this moment, Messenger X is a free application and you will not be charged for our services. But we reserve the rights to add any type of taxes in future after your agreement. Also, some payable features can be added in the future.

You are responsible for all carrier taxes and for other taxes generated by using our Services.

     Requirements

To use our services you will need some hardware and software stuffs and a connection to the internet. Our app run on iOS(minimum 10.2) devices and required an internet connection like a Wi-fi network or 2G, 3G and 4G connection. You are responsible for all carrier and internet costs and taxes.

Also you will need a device that use iOS (minimum 10.2) like an iPhone or iPad.

Also you are agree is need to download and install our app to have access to the Services and you are agree to download and install updates of our app, sometimes the updates can be downloaded and installed automatically and can be skipped or deleted.

     Services

We provide Services of Instant Messages and Calls. It means you can send and receive instant messages from other users registered. Is your responsibility for each chat and file shared using our app. In a chat you can send and receive photos, audio, videos and others files. Is your responsibility for files you send and receive. Also, app provide Services for Calls. In a chat you can send your current location using location services of your device. Please be careful with who you share your location, its your full responsibility. You’re entire interaction with others people including but not limited to calls, texting, photos, share location, videos and audio messages is your responsibility and we do not guarantee for your safety using our Services. Anytime you feel in danger, block the person make you feel un-safety or stop using our app and email us at “safety@trandx.com”.

Our Services are not guaranteed and we’re not responsible for any damage caused of non functionality of Services.

Users are not allowed to publish or send objectionable content. Also users are not allowed to publish or send files protected by copyright.

Is no tolerance for objectionable content or abusive users, they’r account will be terminated immediately if they will offend any person of he publish objectionable content.

     Media Messages

Media Messages is a generic name for the photos, audio, video, current location  and stickers that you send in a chat. You have to understand we do not scan or manage none of this files, so will not assume for any file sent in a chat. You assume any type of file do not violate the copy rights of anyone. Also you understand and agree that any file sent in a chat using our app can’t be deleted from the other users. Also you will never share or make available for public any file receive in a private chat, but is not guaranteed by us.

EMERGENCY SERVICES

You need to understand the difference between our app and your mobile or fixed-line Services. Our app works using the internet and its able to make calls just from app-to-app. It means you are NOT able to call the Emergency Services using our app. It includes but not limited to Police, Ambulance and Fire Department. Use your mobile carrier to ask for help and do not treat our app like a mobile or fixed-line. You are not able to call phone numbers, so you are not able to call at the Emergency Services like, but not limited: 112 or 911.

 

Calls Services

We provide services that allow you to make calls in app. It means you will be able to call other users that is using our app.

A call can be a video call or just an audio call. You’re agree the software not allow you to block calls for anyone, the only way to stop someone to call you is to block that person, and thats include to block any message too.

The Video and Audio Calls quality depends of the internet connection and our server capacities. The Service is not guaranteed and we are not responsibility for any damage caused by non functionality of the Service.

At this moment our Calls Service is limited to call from app to app and you’re not be able to call phone numbers.

Messages are yours

We can’t read your messages. Those are sent end to end encrypted and we are not able to read them. Also it is a very good feature that make our Service more secure. Please not it is applicable just for text messages, all files are storage on our servers or our partners servers but we will never open or use it. Are there just for the X Cloud feature.

X Cloud feature

Is the feature that save all you media files to can get back when you lose your device or switch to a new one. We are strongly work to keep it safe but the Service is not guaranteed and we are responsible for any damage caused for non functionality of Service or for loosing of data.

Your content

Messenger X will consider anything provided to us including but not limited to feedback, suggestions, bug reports and/or contribution on but not limited to our software as free for our use with no obligations including but not limited to payments or copy right.

Private Chats

Any private chat is between two person. You will be required to keep the confidentiality of any text or media file or location. You are not able to share or to make available public any text or files from a private chat, also you are not allowed to make print screens or photos to the screens to share or to make available for public. All private chats have to remain private with all this word means.Privacy of chats are not guaranteed by us.

Groups of Public Chats

Any Group or Public chat have to remain confidential between the members of the chat. You are not allowed to share or make available for public any text or media files or location provided in a Group of Public Chat. Privacy of chats are not guaranteed by us.

Privacy Policy

This privacy policy governs your use of the software application Messenger X (“Application”) for mobile devices that was created by Adrian Vidican. The Application is a full native iPhone app to create realtime, text based group or private chat with Firebase.

What information does the Application obtain and how is it used?

User Provided Information

The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us.

When you register with us and use the Application, you generally provide (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Application, and; (e) information you enter into our system when using the Application, such as contact information and project management information.

We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Does the Application collect precise real time location information of the device?

This Application collects precise information about the location of your mobile device.

Do third parties see and/or have access to information obtained by the Application?

Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Application and our service. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at info@trandx.com.

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you would like us to delete User Provided Data that you have provided via the Application, please contact us at info@trandx.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at info@trandx.com. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy trandx.com and informing you via email or text message. By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us.
